Sample Agreement

You define the role:

During Mediation Session:  

  • Participate in the mediation process with your client, or
  • Focus on the legal issues and refer the client to carry out fact based negotiations in mediation, or
  • Participate in a counsel only evaluative mediation session to address legal issues and obtain an independent, objective assessment of the legal issues, or
  • Use the mediation process as a method of case management by having the mediator assist with narrowing issues, establishing timelines for disclosure and next steps 

Outside of the Mediation Session:

  • Draft Agreements and Releases based on client negotiated terms as summarized in a Memorandum of Understanding prepared by the mediator and clients; or
  • Request the mediator to prepare the Agreement and Releases for your review; and
  • Provide independent legal advice before, during and after the mediation process. I recommend and encourage every participant in family mediation to obtain independent legal advice to prepare for the mediation sessions and finalize any resolutions.
